Attorney Kevin M. LaMontagne is a graduate of Duke University School of Law. He has been practicing in Boynton Beach, Florida since 1991 when he established his office there after first having practiced in Boca Raton and Palm Beach, Florida. He has a wide range of transactional and litigation experience and has successfully assisted clients with a wide array of situations and problems, including both personal and business matters. He is a Member of the Real Property, Probate & Trust Law Section of The Florida Bar, the Trial Lawyers Section of The Florida Bar, and the Business Law Section of The Florida Bar.
Kevin is available for representation of clients in a host of estate planning matters and related issues, including the drafting of wills, trusts, durable powers of attorney, health care surrogates, ladybird deeds (also known as enhanced life estate deeds), and pre-need declarations of guardian, and many business matters, including, importantly, the formation of LLC's to protect clients who own and hold rental properties. He is also able to assist and guide clients with a host of other challenging legal issues which they may encounter.

Kevin has represented business clients in important transactions such as commercial leases, business contracts, formation of business entities, and commercial litigation. Kevin has also advised and assisted clients with regard to shareholder agreements and LLC operating agreements.
Kevin has successfully litigated real estate contract disputes, business law disputes, condominium disputes, including one in an arbitration context where he prevailed against one of the best known and most prestigious condominium law firms in the state. Kevin is also experienced in appellate work, including a recent high profile appeal in an environmental law case.
He represents clients of all ages in important legal contracts and other legal transactions and disputes in which they are involved, including drafting probate and trust administrations, review of residential leases, evictions, foreclosure defense, and prenuptial and post-nuptial agreements.
Kevin has represented clients in both residential and commercial real estate transactions. Further, Kevin is a Florida licensed real estate broker and has been since 1998, successfully assisting many sellers in their real estate brokerage transactions for decades through his own real estate brokerage company, Sellers Only Real Estate Brokerage Corporation.
Kevin understands the special needs of seniors and elder law issues. For 13 years he offered free consultations to seniors at the Boynton Beach Senior Center, taking over from attorney Allen William Martincavage who Allen requested that Kevin fill in for him on what both of them thought would be just a short term. Upon special request, Kevin has made special appointments to meet prospective or existing clients outside the office, including visits to independent and nursing care facilities and hospitals when an exigency exists.
Kevin has represented clients in Chapter 7 bankruptcy proceedings and is experienced in bankruptcy litigation.
Kevin has been a member of the Florida Bar since 1982 and is admitted to the Federal District Court for the Southern District of Florida and the Bankruptcy Court for the Southern District of Florida.
Kevin earned his B.A. degree from the University of South Florida where he graduated in 3 years, magna cum laude. Interestingly, however, Kevin's undergraduate studies were more pre-med than pre-law, including the series of three calculus classes required for math and science majors (not the more basic calculus class for students who were not math or science majors), for which he had a 4.0 average. Kevin has enjoyed the sciences ever since his time at Cardinal Gibbons High School in Fort Lauderdale, Florida, where he was awarded the four-year science award, awarded to one male and one female in each graduating class. It was not until late in his undergraduate years that Kevin decided on a career in law rather than one in the sciences after he took a business law class and a logic class, both of which he thoroughly enjoyed. Kevin is happy to this day about his decision to become a lawyer, as he loves the practice of law and assisting people with their legal needs, including helping many people who find themselves in extremely difficult legal predicaments. In his spare time, however, Kevin still loves reading science and learning about the newest scientific discoveries and breakthroughs.
